You can't kill someone who is mentally ill because they are not making those decisions in their right mind. It's almost like they are backseat to how their mental disorder is making them behave. What boggles the mind is that since 2002, he should have already been executed for acts of terrorism. If the plea didn't hold for the Boston bomber, it shouldn't hold for the Joker. Or...

The Joker keeps escaping before the sentence is dished out and when he gets caught the next time, the slate is wiped from being drafted into the Suicide Squad's payroll. Which again... begs the question on why he isn't a federal case.

Joker's a crime lord, but the sheer number of times he gets caught and ends up not punished for it has just worn down on the reader. That's why they keep pushing him into supposed "he can't have survived that" and "can't find the body" scenarios, to keep from falling into the rut.

No matter the DC universe, the general public seems to be a bunch of dupes.
