I don't know why you guys are laughing. Per SEC treatment, these are securities and therefore must abide by securities laws. That includes insider trading.

Now, im not saying anyone will get prosecuted. It happens with penny stocks all the time ans they do nothing.

Trouble or not depends on his answer and possible NDA and on how such things apply to an unregulated market.
