The way I see it they're either rolling back transactions to include the first 250k eth or they're trying to imply their ICO extension wasn't a massive breach of terms.

No. 250k was the hard cap, however it didn't apply to the first hour. First hour was basically uncapped. They extended that to 3 hours on their own.
