The domain was really fucking good for a start. Not sure hot it was taken. Anyway, porn sites tend to pick up traffic way faster than blogs and other sites. Not sure what kind of sites you set up. I never spent a dime on advertising.

If you as the site operator upload the videos, it's your liability. But if you only host user-uploaded content (like YouTube or 4chan do), it's the liability of the uploading user. You as the site operator only have to comply with DMCA take-down notices.

Nobody's 100% safe. But as long as they don't find out that Donglovr5078 is actually an alias of David Mudkips, David would be pretty safe. Altough, you should have at least 20-40% of conceivably user created content without obvious studio logos. These schemes only come to light when the owners are criminally prosecuted and admitted them in internal mails. But the criminal complaints only happen if you operate a clearly illegal site and usually only if the rightsholders don't get what they want from you in other ways (see: Megaupload).

We can only speculate. Since he mentioned starting out on wordpress, he probably never even attempted to make it look like user generated content. Maybe he plastered his site with obvious references to piracy. Maybe he only hosted full videos from major porn sites. Maybe he offered downloads and torrents. And he mentioned above that he pretty much folded on the first threat of legal action. Maybe he could have won in court, who knows? The obvious answer is of course: He didn't know about DMCA or didn't offer compliant contact information for a DMCA agent. No DMCA safe harbor means he's immediately liable for all the content on the site - user generated or not. Or, you know, his local laws are much stricter since we don't know where he lives.

Depends on where you live, but generally no. You always have to pay your lawyer in advance for a legal battle that may well span years. And only in some country can you recover those payments once you win. If you live in the US it can easily cost you 100-200k just to fight a bullshit lawsuit. And once you win you get nothing of that back. This is why extortion settlements are so effective in the US. It's literally cheaper to pay 10k to avoid a bullshit lawsuit that would *at least* cost you 20-40k if you won pretty much immediately (little discovery, motion to dismiss, no appeals).
