Using a commonly used phrase as a business or website....is it legal or advisable?

Lets say for instance the commonly used term topkek on b. IF I had a website topkek.com that sold stuff, and created a logo and everything, would it be completely legal to sell t-shirts or whatever product? Could it become a brand name and trademarked with a proper slogan?


That is NOT my site. I am wondering if this is possible in principle.
