Help me solve an argument here /biz about salary v.s. hourly employment

Is this employee exempt or non-exempt or as I suspect an employer illegally picking a choosing which parts of each they likes?

Also sounds like he's getting fucked royally, should probably look for a new job.
I would quit that kind of job today.

I also work at a tech company. I make 70k, can come and go as a please as long as my work gets done. No overtime, but no undertime dock either. Once I leave for the day, I'm not expected to be reachable.

I think the case here is that he's young, inexperienced, or just pretty new to the field. He can end up making money like you, but he'd have to start somewhere.
