but in most cases all the company gets is not sued.
as in, not promoting women at a rate about equal to men can very definitely get you sued. In the US at least.

In NC a some companies get thousands of dollars per X convict they hire. So some will only hire criminals, even some that never graduated high school. Some of these jobs pay decent money too. I'm not talking McDonald's pay, but 2-3x that

as a government contractor you have to do EEO compliance audits on yourself and generally have to give your audit info to the gov where it potentially becomes public information.
So if you're hiring or promoting more men than women there's going to be some questions raised. It's not necessarily a problem if you can show that you didn't get any qualified female applicants, but if that's the case you'd best document it so you can prove it.
otherwise your hiring practices should show both men and women advancing pretty much equally or at least in proportion to their presence in your field. It's not really a quota, if your field of work has as many women working it as men you should be promoting as many women as men, otherwise you're discriminating based on gender.
