#2 - You can THREATEN to sue for the $40 + Legal fees. You could get ~$1240 out of them depending on the lawyer. Some work for $500/hr.
My point is, there's no way they'll let it get to court. They'll just settle and give you your shitty $40 that you DO NOT DESERVE.
