Taxes. The government wants to make sure they get their share of the server's tips not just of their wage. So, they lowered the servers minimum wage and assumed they would get tipped enough (10% or whatever) and tax them on that 10% tip estimate whether they get tips or not. If all transactions were made via a card, no problem. Just tax them on their actual tips. The problem is the cash tips that never get reported.

Changing this is next to impossible because the IRS (obviously) and the restaurant would lobby congress to keep things the way are because it lets them pay their servers less.

Tips are dumb. (And yes I do tip.) First, from your comment, the waiter/waitress is not cleaning my plate; that is the bus boy and kitchen staff. If anyone in a restaurant deserves a tip it is the cooks in the back. I lived in Japan, where there is no tipping, and quality of service was better than anywhere in America; so don't tell me tipping gives me better service. Also, when food prices go up, restuarants charge more, which means waiters get bigger tips. Know who doesn't get paid more? the kitchen staff, because the restaurants are trying to keep their costs down as much as possible for consumers. Getting rid of tips would save a lot of stress on consumers too, I hate doing math at the end of he meal - who the fuck wants to do that! I could go on all day, but those are my biggest gripes.
