For example, when an action or policy undertaken by the federal government will result in undue hardship upon a foreign national or alien, there is recourse to the courts within the United States.
Federal judges didn't just invent law here, and I don't have the time to run you through a course in international and constitutional law. You'll have to take out student loans for that.

That's not exactly how federal and constitutional law works. It's not "balance whether we'll inconvenience this person versus whether they're a terrorist" but rather "will this policy cause undue hardship."
The decision as to whether this person is a terrorist and should be detained is a criminal matter left up to law enforcement, not for the courts to interpret on a case-by-case basis.
