In my post i clearly said both were waiting. In this case, when it is clear, straight/right always goes first.

well, here in NZ its both tricky and simple
if you're car A, and you've already stopped, and you can see car B approaching the stop sign but know they have not yet stopped, legally - B must come to a complete stop & check the way is clear. If you can be in the intersection before car B has come to a complete stop - then they'll still have to make their complete stop, and as you'll be in the intersection by now they'll have to yield to you. if car B chooses to run the stop sign and smashes into you, you'd need to prove that their failure to come to a complete stop was unlawful unexpected behaviour causing the accident, and that you were well and truly in the intersection. tricky because with the stop sign affecting car A & B - legally they need to stop and stay stopped until the way is totally clear in all directions.

having said all that, as a defensive driver of car A i would be inclined to yield to B, because many folks don't obey stop signs and its best to assume all drivers are completely fucking retarded.

if you were both stopped simultaneously, then car A should give way to car B because turners give way to straight through traffic.
