It really depends on the jurisdiction, but generally the answer is no. There is a scienter/intent requirement for most crimes, and this scenario demonstrates a lack of intent to actually commit a crime. If the "victim" know all along that the blackmail isn't real and can stop at any time, you're probably pretty good. However, if the "victim" asks you to stop (like with a safe word), and you do not stop, from that point forward you are likely committing a felony.
