if my apartment advertises "gated community" but never actually closes the gate do i have any legal right to terminate my lease without paying fees?
i moved in 2 weeks ago and they gave me a little NFC card to open the gate, but the issue is the gate is NEVER closed and the common areas are always flooded with people who don't even live here.
there is a really nice pool + clubhouse with free stuff and a grilling area with a fire pit and some really expensive outdoor grills, so i think people are just coming here to take advantage of our stuff.

it advertises "Gated Community" so do you think theyll make me pay the termination fee (700 dollars) if i try to cancel my lease? this is the most expensive apartment around the area so i can easily go somewhere else for less money than im paying now, but i wanted to be in a good area

You could but you might have to take them to a small claims court. Take pictures for about a month and see if you can get a witness.

Can't you just ask the landlord/manager to close the gate?
