Its not federal law to drug test employees, OP. This is for the most part a case by case an employer issue. You usually dont know if youre getting tested or what kind of test until the subject comes up or they ask prior to an interview.

If its a swab test youll be fine just stop smoking immediately and chew gum use mouthwash etc.

If its urine or hair youre probably fucked unless you cheat.
