So my friend was caught with 3 hits of acid last night and got arrested. Other than this he has a paraphernalia charge from a few months back (he's really been fucking up lately). What are the odds he will go to jail? Everywhere I look online tells me something different, I'm looking for people who have any personal experience in this area.

With a misdemeanor prior for drugs he's looking at a felony charge. Your friend needs a lawyer, if he catches the wrong judge theres a very real chance he'll do a year.

If he's white he might be able to get a plea bargain. If he was in Cook he'd definitely be looking at probation. Being in DuPage, where they aren't stretched quite so thin, I wouldn't hold my breath.
Also, I have to wonder how your friend managed to get searched by the police twice in a few months. I carried a concealed weapon for a decade in Chicago before we had shall issue and never had a problem, despite being the kind of person involved in some seriously shady shit. Hell, I haven't had an interaction with a cop more serious than a speeding ticket since I was 16.
