It's almost like this whole case is stacked against me.

To make a long story short: dog escaped from the house yesterday, biting a little girl in the thigh before I could retrieve him. I didn't know about the bite at the time until today when an officer came to visit. The girl had to go to a hospital; I don't know the severity of the bite, but I'm guessing they're going to sue. Then, to make matters worse, he bites the police officer when she tries to pet him or something (I wasn't the one at the door). It's nothing major with no blood and no stitches need. Still, it isn't helping my case. I know a lot of you are going to say the dog needs to be put down, but you have to understand. I love this dog. He's my partner in everything and best buddy. This just seems so out of nowhere. I don't know what's wrong with him, but I *am* willing to take the steps required towards a treatment plan. But still, I dunno. Two bites already being filed with the police. This is bad. I hope the girl is okay. I just don't think I'm ready to give up the fight for my friend. I want to find a lawyer who specializes in this kind of law, pay the defending family, take the steps necessary for my dog, etc.

Anyways, anyone have any advice for me? Legal, hopefully.

immediately look into some sort of dog training class, and get him in it immediately. when you show up, explain. explain hes in class. dont show up and say 'OH I PLAN ON LOOKING INTO SOME SORT OF CLASS'

hopefully hes young and you can argue that you havent had a chance to train him but by your bond sounds like you've known him a long time.

but if you REALLY love him, you'll get rid of him. find him a loving family as far away as possible and pray he doesnt bite again.

This, definitely this. Also, if he's a rescue, you can definitely argue that you're trying to fix the bad habits of the previous owners, but you need to show that you're taking steps to train. Not all dogs are people friendly, my chow HATES BEING TOUCHED like she's autistic, but they should be able to see a person and have a person approach them without going off. If it's a pitbull then you ESPECIALLY need to get some discipline classes for you to learn to take chaege in because they are more prone to biting if they have poor leadership at home.

Exercise is another thing. Biting can be a symptom of a lack of it, especially if he goes nuts on people when he gets out. Walk him a lot so being outside isn't that big of deal.

I imagine it was an animal control officer, not a regular police officer. Any time someone has to go to the hospital for a dog bite, they send one to assess the dog's aggressiveness. Sometimes this leads to an order to put down the dog. I remember when I did a dumb thing as a kid and my dog bit me in the face, I had to get stitches and an animal control officer came by to assess my injuries and the dog.

All right, so here's my plan. Comment on it please. Going to get some legal counsel, go with training immediately like suggested, try to make my case about helping him, not pinning it against the others. Also, from a legal perspective, how at fault is the dog here with the officer? They just requested to see him and touched him gently.

Depends if the person who was with the dog led the officer to believe that the dog was not aggressive. If they said something like, "oh yeah, he loves people!' Then gets bitten, that's negligence on the part of the owner, and makes it seem like the dog is unfit to be around people but the owners are too retarded to realize it's not.

That's good. Unless the girl was an infant or a toddler, I don't imagine that the damage was that bad unless she ran up to the dog and tried to hug it and got bitten in the face. Dog bites are more likely to slide if it's a smaller dog because the injuries aren't as severe or disfiguring.

Also, has no one contacted you about the dog's shots? That's like the number 1 thing, to see if the dogs rabies shots are up to date.

I imagine that the parents may ask you to pay for the medical bills, so I think if you refuse to do that then they'll sue. That's usually how minor bites are handled.

You could argue that you didn't give her permission to touch the dog (which she should obviously know is violent since she's coming to you for that) and she assumed her own risk by approaching it.
Otherwise, good luck man idk what you can do. Shits corrupted enough when it comes to dog attacks. I had a friend who had to watch her dog get put down because some piece of shit little kid who's parent's weren't watching it trespassed into their yard and got bit because they were hitting the fucking dog. They lied through their teeth the whole court case, but unfortunately there wasn't enough evidence to prove their dog's innocence, only evidence was a bit mark on a kids face. Know another person who got charged with animal abuse too because the other person's shit unleashed lab was attempting to maul her yorkie and she kicked the bitch in the jaw to save her own dog. Lab wasn't even seriously injured. And I'm your neighbor across the Mississippi.
But your dog did get loose, accidents happen I know, but you should have secured your dog better. Lawyer up, thats all you can do at this point.

Talk to your homeowners insurance.

Unless you knew the dog was dangerous, there are no legal consequences. Basically to win any more than hospital bills, they have to prove three things:

1. That you had a duty to perform some act
2. That by not doing it, someone got hurt
3. They lost money as a result / money will make them whole

A dog bite by a small dog will result in your homeowners insurance paying their medical bills and that's pretty much it.

But holy shit, anon, get a trainable dog, train it, and make better choices because holy shit, this could have been real bad. I fucking hate irresponsible dog owners like you.

I used to be an assistant for an animal physical therapist and did some work with strays and rescues for a bit. No legal training, but just reporting on what happened to people I know and myself, so I can't give you 100% legal advice but some observations that I've run across over the last 10-15 years might be helpful in anticipating what might happen.

Maybe you should send your dog to a friend or family's house for a little while until this pressure blows over and then see if you can get them some treatment. Aggressive behaviour always stems from some bad experience or fear within the dog. It can be remedied but it might take a long while. I always hate it when people just slap a good or bad label on the animal without trying to work with them.

This is good to consider too. The parents are really the unknown variable in whether you're going to get sued or the dog is going to get in trouble.

I was bitten by a samoyed in the arm (I was trying to pet it through the fence) and once my parents determined that it had its rabies shots, they left the family alone because it was my dumb ass fault. My aunt had a German Shepherd that got out one day and bit a kid on the ass, but she avoided legal reprecussions because she proved that the kid would throw rocks at her dog whevever he got the opportunity. I was walking my Chow Chow one day and a little girl came running up to pet her, even though I told her to stop and put myself between her and the dog (kid fucking dodged around me to get at my dog). My dog snapped at her hand and little girl flipped out, but neighbors were present and saw that I tried to prevent her from getting near so no legal action.

Anyway, those are just examples of what COULD happen. It all depends on what happened to lead up to the bite occurring and how the parents choose to respond.

You need a lawyer. A real one not a 4chan lawyer. Start looking up ones in your town man, even if you don't think they specialize or handle this kind of thing, just call up the first one from the google search and ask if they can refer a specialist if they aren't one.

They often quarantine dogs after a bite, though usually it is in the owner's home. The fact they're taking the dog is probably to separate whether the dog is truly vicious or if it is protective (pure conjecture here).

I know you don't have the luxury of time, but make sure to research your potential trainer. It's a very unregulated field and a lot of people have no idea what they're doing. Consult /an/ for more help.
