He's 16/17, which is legal for beer some parts of the world, and the show isn't set in Japan. I have no idea how the law is written, but it would be weird to forbid you from depicting, say, a 19 year old drinking wine in France.

If they don't want to show underage drinking, then media has to comply. I'm saying it's unusual since they are not lax about it, manga and novels are harder to regulate but anime usually gets changed (think Haruhi's island arc and HidaSketch's welcome party)
