Correct. Every single private realm receives these. Nost got scared and decided to try and work with Blizzard. It was their decision to take down the server.

Blizzard can send out those C&D with little cost. To actually persue litigation is not worth their time or money when it comes to these small non-profit private servers.

I'm honestly curious if the char creation lock would even help more than it hurt. Like say I play on launch day and make an orc, then convince a buddy to play a few days later - but he can't due to character creation lock on horde side.
I think it could definitely work as far as helping balance things out but would also be absurdly goofy for anyone coming late and possibly force them to play something they don't want to.

Past that it would require custom changes like portals to access out of reach places that a lot of activity takes place on. Which would kind of neat since it would create a pvp hotspot but kind of stupid as well.
If I were to choose a "solution" to flying (assuming there needs to be one) I'd make a custom item, dropped from something rare or perhaps behind a grind of some sort, that dismounts players.
Similar to the turtle shell from MoP (and believe there are similar items in WoD, maybe Legion) with a longer range, cast time of some sort, and only usable from the ground. It wouldn't be perfect but would prevent someone using flying solely as a way to avoid a fight. And if only useable while unmounted on the ground would let people afk and float if they feel like it as well.

Well different guilds can vary for sure and it's totally possible that I've just had bad luck.
But as an example, the alliance guild I was in on elysium before I took a break (then they merged into another guild) would have 12 to 15 people in the voice chat at all times, night and day, chatting while questing/leveling/whatever.
And they were all pretty nice, but if you didn't join you were kind of an outcast. So I would, and it was like being on a bus that you can't get off of and listening to people chat about stupid fucking shit.
Again, they were nice dudes but if i wanted to listen to chatter all night I wouldn't be in my comfy room playing a video game from 2006.
Other than that the guild was great, raids went smooth, everyone was nice. But feeling required to small talk for 8 hours is exhausting, and I'd make excuses (music, wife agro, etc) and then get asked later on "hey man, how come you're not in voice dude".
