The way I got it set up, it hardly ever hangs up and I can accomplish all the necessary functions without crashes.

I've got a N3DS. I updated to 9.5.
Got RX 3.0 and a custom theme installed.

And it all functions like a normal 3DS with eshop fuctionality (Sans downloading for now)

Depends on what format you're trying to update. If you've got a cart or a cia file that matches your region use the update option while booting the game with wi-fi on, if you have a different region cia you need to find an update specifically for that region and apply it. You only need one update, the latest, and a DLC unlocker .cia to get everything

All that happens at you have to do the process because sysupdate isn't very well optimized on the N3DS, but all you have to be is not an idiot and you're N3DS won't get bricked.

For anyone having issues installing Smash DLC, you have to install the DLC using bigbluemenu cia manager. Install it with FBI then install the DLC cia with bigbluemenu

rxTools didn't seem to work (stuck with crashes at the purple booting menu).

From a backup started using cake, now in the purple boot when I selecte homebrewmenu to do my things, it simply crashes in black and red

The idea is, assuming you've unlinked the two, The SysNAND and EmuNAND are basically two completely separate 3DSes inside your 3DS. The SysNAND is the "real" one, the one you don't screw up on pain of bricking, and the emuNAND is the sandbox/holodeck that you can do anything with and not worry.
You CAN fuck up your sysNAND as much as you want and then restore it assuming you have a NAND.bin backup with zero consequence to your 3DS as a whole, generally speaking.

Okay so I just tried pimping my 3DS with some bitching themes. Here are my results so this shit doesn't happen to anyone else.
I use menuhax to boot into rxTools cfw so keep that in mind.
Tried installing my themes as a cia file using FBI, shit didn't even work. It installed but didn't display the themes.
I tried again with BigBlueMenu and it actually worked, down to displaying the themes. I could select ONE theme and everything was fine, but when I chose seven themes to rotate them it created more save data and shit got fucked. I was locked out of menuhax so I had to run browsehax again and uninstall/install menuhax again
tl;dr if you use menuhax as your entry point don't even fuck around with themes, not worth it imo desu senpai

Pirate's Curse (3) is the best one, I personally disliked Risky's Revenge (2) but it's not a bad pick I guess. First game is great, nothing wrong with it instead.
If you just want to go with the best, go with 3, if you liked it feel free to play 1, and if you want 2, skippable imo. If you want to go chronological order for the story, it's not a big deal because they give you a sort of background of every character and what happened before, but I still would recommend playing the first game of a series first regardless. Start with 3 only if you want the best from the beginning.

There's no point pirating on the 3DS unless you're underage or extremely poor.
A couple years ahead you'll realize you have nothing, no actual games, no collection, nothing linked to your account, nothing to transfer to the new systems.
Just the rompacks everyone owns for archival.
