I think that it all comes down to the probability that studios will find you. I haven't heard that the ISP's are looking for people who torrent, so they leave the task to find these people up to the studios who have the rights to copy.

Studios know how to use google, about the top sites like TPB, etc... They just search for their movie, TV, porn, whatever.

At the end of the day, it costs the studio money to pay some tech guy to find you, which requires opening every torrent that will have their copyright content, scanning what IP's are connected and downloading, etc...

IMO there are factors which can reduce your chances of getting caught:
1. Download torrents using VPN's -- If they think that you're in Russia or Sweden and not from the US, then they won't attempt to go after you
2. Download torrents from private trackers -- Limits their access to find torrents and connected users
3. Don't download torrents while they are popular -- The studios usually lose interest in you when general the interest in their content goes down. Soon enough they have newer content to try and protect so they give up because the ROI goes down.
If a new episode of Game Of Thrones airs, torrents start being available like an hour later, and IMO that's the best time to connect and get a lot of IP's of copyright violators, but they aren't going to care next week about that episode when another just came out.
4. Don't download popular things

You'd have to examine each link here and ask yourself "how easy would it be for some tech guy to find this torrent in 15 minutes?"

I'm not very familiar with where magnets get their data from, but magnet links may just be from TPB anyway, so there's some challenge. You could do some detective work to find where the magnet came from.
