Federal Courts have officially ruled that the 1st Amendment covers wearing military awards you haven't earned and lying about service
This apparently also extends to lying about your military service on the stand during witness testimony in a criminal case
>Swisher testified that David Roland Hinkson offered him $10,000 to kill the federal judge presiding over Hinkson's tax-evasion case. Swisher said Hinkson was impressed after Swisher boasted that he killed "many men" during the Korean War.
>Prosecutors say Swisher enlisted in the Marine Corps a year after the Korean War ended but was never wounded in the line of duty. Swisher was honorably discharged in 1957, and discharge documents indicate that he didn't receive any medals, according to the 9th Circuit ruling.
>During his 2007 trial, prosecutors showed the jury a photograph of Swisher wearing several military medals and awards, including the Silver Star, Navy and Marine Corps Ribbon, Purple Heart, and the Navy and Marine Corps Commendation Medal with a Bronze "V."
Nothing illegal about pretending to be a doctor as long as you don't try to practice. Name one good reason (besides it being disrespectful to vets) that lying about your job should be illegal ever.
Lying about it under oath should still be perjury, but what the lie is shouldn't matter.
No, for it to be identity theft you need to be stealing a specific person's identity. "Stolen valor" is only a crime now if you seek to profit from it.
There are two cases involved here. The first was the case Swisher was called on to act as a witness. He showed up in his military uniform, covered in medals he didn't earn, talking about how he "killed many men" in Korea. People noticed this and looked into it, then learned he enlisted after the Korean war ended and never earned any medals. The prosecutors' comments are related to his own criminal case, not the first one where he was a witness.
>the first amendment says you can't be prosecuted for being a lying Asshole
Oh no, whatever will we do if Americans are allowed to say and do things that don't physically or monetarily hurt anybody?
>welfare queens in charge of understanding or supporting the constitution
Meh, i could care less as long as they dont..
A) Try to take charge of an situation by using rank they did not earn, like that one guy who tried to take charge of first responders because he was pretending to be a SOF medic. (he got V&)
B) try to get benefits or other monetary gains.
I do enjoy laughing at them during youtube videos.
OP here, didn't say I disagreed with it. The Stolen Valor act was unconstitutional as fuck. So long as someone isn't defrauding the public and trying to profit from it, IDGAF what they choose to dress up as.
it minor details might be wrong, was on /k/ a year or so ago.
There was an accident or some kind of emergency, and some chucklefuck in a uniform tried directing first responders, and fucked up, and then got arrested and charged.
hello this is roger, esq., attorney at law, posting from my lenovo thinkpad Edge E530C
first let me clarify a couple of things
1. so "federal courts" don't do things together. this is what one circuit did, and doesn't bind the other circuits. the 9th circuit where this happened is basically california, a bunch of states with as many people as guam, and guam. until anything else happens that's as far as the decision goes
2. the stolen valor act that criminalized faking your service was already struck down by the US supreme court in 2012 because lying is free speech
3. the reason lying is free speech is because the constitution prohibits content-based restrictions on free speech, even lying, like the new york daily news, unless there's a really good reason
4. this isn't a good enough reason
they government did put a database of medal recipients up so that it's easier to check on whether a person is doing this but let's remember that broad reading of constitutional amendments is not only a good thing when it has to do with something you like
i'm literally a lawyer
No anon, your service of vaccuming parking lots only gives you minor things like (shitty, but cheap) healthcare, great loans and other shit from the USAA, free college or just a cold hard cash payout, and free shit from applebees once a year*
*List is not all inclusive.
never heard of it.
if u are offended by my showing off the stuff i buy when im not supporting your mothers reach up grant then i suggest you take her advice "dont take it out until it gets soft"
This is complete fucking bullshit I didn't do a tour in MEPS so that fucking civvies could walk around wearing OUR uniform and pretending they know what WE went through.
Fucking civvie liberal commie judge better reverse this fucking bullshit fucking faggots
If I ever see one of these little shits trying to steal valor in public Imma show em what they taught me at Ft. Sam Houston and shove that uniform straight up their ass
If you joined the military just so you could walk about and get discounts, then I have absolutely no interest in you or your opinion.
Cry harder faggot, shame an IED didn't blow of your fleshy hands so you can't type.
Well I'm glad the supreme court made the ruling it did.
If they had gone the other way, it could have paved the way for ALL SORTS of anti-First Amendment type laws.
I sometimes wonder if those westboro baptists were at all purposed for inciting Americans against their own First Amendment.
I just hope the supreme court shows the same wisdom when any rulings concerning the Second Amendment show up.
>for the fags mad that "stolen valor" is still legal
Holy Fuck, think about the implication of any law that would make that specifically illegal. Just try to come up with a fool proof method that doesn't also set precedence for limiting the free speech and free expression on something that matters to you.
Stolen Valor has, is and always will be something that should be handled unofficially with public shaming, aka using your free speech too.
>Just try to come up with a fool proof method that doesn't also set precedence for limiting the free speech and free expression on something that matters to you.
"Impersonating a United States soldier in public without the reason of historical reenactment is blah blah blah"
>Based of the 2016 Anon's Stolen Valor Law, we have can draw a reasonable conclusion that the practicing and drilling of military style assault technique a shooting ranges is tantamount to impersonating a US soldier.
>Furthermore, we are broadening the scope of the original law to include the purchase and/or sale of any "military style assault weapons."
I didn't even try hard, really the first part would be stepping all over you talking about something someone in power doesn't want you to talk about.
>We are further protecting the freedoms of all Americans by additionally outlawing and inflammatory speech, or support of criminal acts and/or stated resistance to the law.
Now pick up that can.
Haha mad cause your girl left you for the real fighting man she knew your faggot ass would never be
I got TONS of head when I got back
What'd you get after you got back from your gay little liberal arts college, other than homo-aids of course
Of course not.
Posted from one of my 7 iPhone 6s', while sitting in my 17,000 USD couch in my mansion just in Virgina, just a five minute walk from the beach using the stone path laid down by hand on the otherside of the garage with my McLaren P1.
>dress son up as a soldier for halloween
>decide to add to it and add a few badges I bought at the BX
>walking around the neighborhood making sure he doesn't get kidnapped
>walk up to one house, has a bunch of "veteran" stickers on his lifted F-150
>also has a "be mindful of PTSD" sign in the yard
>son knocks on door
>a fat fuck wearing a Marines hat and T-shirt opens up the door
>"Trick or treat!"
>closely inspects my son's costume
>pulls out his smartphone, starts recording
>"Aviator badge, army ACUs, Marine rank..."
>"WHAT WAS YOUR MOS HUH?"
>confused, my son replies "I'm an army soldier!"
>"WHAT WAS YOUR MOS YOU STOLEN VALOR NEVER-SERVED PUNK!"
>starts screaming at my son
>"I BET YOU WERE KICKED OUT OF BOOTCAMP YOU FUCKING PUNK"
>"STAFF SERGEANT? YOU DON'T LOOK A DAY OVER 8. HOW THE FUCK IS SOME BABY-FACED SHIT SUPPOSED TO BE AN NCO YOU LYING COCKSUCKER?!"
>run up to confront the man
>"What the hell is wrong with you?"
>"YOU'RE DEFENDING THIS STOLEN VALOR PUNK? WHAT WAS YOUR MOS?"
>"I was a BMC in the Coast Guard, we don't have an MOS."
>"FUCKING PUDDLE PIRATE WISHES HE WERE A MARINE. DEVIL DOGS JARHEAD OORAH."
>man goes back inside, I call cops
>my son is crying, having his day ruined
>cops arrive, arrest my son
>"Sorry kid, the Supreme Court doesn't protect your fake uniform"
>get fined, son has to do community service
>fat fuck uploads video to YouTube
>3 Million Views, goes viral on Facebook
>get death threats in the mail
>land of the free
guys this doesn't even count as bait, just stahp taking it serious. staaahp
Noooo../ I was trying to tell that guy who was telling the other guy off that guy isn't serious because he sounded legit mad but now i am ensnared in the process i was trying to help others avoid
ill sudoku my way out
Anon, most people who were themselves actually in the military, and weren't a truck driver or a water specialist constantly spouting off "I was like infantry but..." just do not care.
>Federal Courts have officially ruled that the 1st Amendment covers wearing military awards you haven't earned and lying about service
Who cares? Yeah it's a douche thing to do but I never understood the people who completely sperg out about "stolen valor".
>This apparently also extends to lying about your military service on the stand during witness testimony in a criminal case
THIS HOWEVER lying under oath is a crime and lying on a witness stand is perjury.
We have lot of fakes in the martial arts community too. You won't believe that amount of people that walk around with fake belts, gi, and other awards. So many people have told me they were personally trained by Bruce Lee.
That's fucking lying though, I know I sound like a kid for that, but come on, is nothing sacred? Is there no such thing as honour anymore? If I had served and I caught out some faggot lying about it, I'd make sure he'd at least have to eat through a straw for six months.
Being a veteran carries no authority. It is in no way comparable to impersonating an officer. Perhaps if they tried to gain entry to a base and pretend to be active an active duty officer or something.
Kicking your ass is illegal, and a great way to get dishonorably discharged from the military!
>PFC Johnson, why were you arrested by sheriff's deputies last sunday
>Sir, because some faggot was stealing our collective valor!!!
>You're objectively an idiot Johnson. You could've easily publicly shamed him and been in the right. Now you too will have to lie about your military record to impress women and get discounts at one of America's many fine retailers. Oh, and remember first class seats being offered to you by generous civilians?
>You'll have to steal some valor to get those too!
I get the anger at these fools, especially if it's your uniform they're lying about, but actively seeking out these type of stories to get upset about makes you almost as bad as the fags who steal the uniform.
It's like a loser dressed like the cool kids, and one cool kid just rides the loser for it forever.
Part of being cool is not giving a fuck. And anyway, vets shouldn't get special treatment unless they have a physical or mental handicap.
Problem fucking solved.
>but actively seeking out these type of stories to get upset about makes you almost as bad as the fags who steal the uniform.
This. Who's sadder, the stupid fuck who has to get a bunch of rusty ass medals so he can get a free Starbucks, or the sad faggot who spends every waking minute trying to out them?
>And anyway, vets shouldn't get special treatment unless they have a physical or mental handicap.
And this as well. Part of the problem is that we excessively idolize our vets and treat them as saints for doing their damn job. You don't congratulate a bus driver or thank a cashier for their service with a free beer. If they didn't want to risk their lives fighting in wars they shouldn't have enlisted. End of.
Nations that are great military powers tend to idolize and give special treatment to their military. Getting angry at that is pretty stupid. It's only natural to pride yourself on your strengths.
Reminder that /k/ hates the US Military, hates veterans, and we have years of archive material of edgy kommandos bragging about all the servicemembers they're going to hunt down and kill in a SHTF scenario.
/k/ LOVES that this happened and so does most of the nation. This is the most anti-military period in US history since Vietnam.
Good, we don't like soldiers who willingly went Iraq/A-stan and destabalized the entire middle east for oil/Israel.
It's Bush's fault for the creation of ISIS, and our fault as well. Our meddling is causing the world to go to shit.
>Good, we don't like soldiers who willingly went Iraq/A-stan and destabalized the entire middle east for oil/Israel.
Lol umad. I'd go again. In fact I'm finishing up school and talking to a CIA recruiter so I can do it again as a civilian.
>not noticing the arfcom satire
how asshurt of a poj "vet" with no interesting stories must you be anon? deployment doesn't mean shit when you fixed trucks and got psd from a mortar impact 200 yards away from the far side of the FOB as you slept. Stop putting out "don't use fireworks on the 4th of july M'cay they trigger me" signs and start drinking heavily like veterans of every other war on the planet.
I'm sorry that I disparaged your awards. Its not like you guys dont do that yourselfs.
Fuck this. Stolen valor faggots should be arrested and charged, no exceptions.
Can't be soon enough. I fucking hate when one of you cum-guzzling neandrathals walks in with your shitty camo while I'm trying to eat and start begging for free handouts. Fucking makes me sick.
>offering discounts to any person willing to spend $8 and half an hour at a pawn shop
>not asking or checking for any type of CAC or mil ID
It's the definition of a victimless crime. I literally can count on one hand the amount of times Ive gotten the discount using my ID.
>>/k/ will ask for eotech to honor 100% MSRP refunds for 8 year old optics with no problems
To be fair as soon as I bought my first EOTech I noticed it had parallax and called them up about it. Also the XR308 reticle was different than listed on their website and over 5 years later, they still havent bothered to fix it. Thank god for Aimpoint fanbois causing so much butthurt that I could get rid of it.
No, it's an anonymous imageboard where calling an asshurt POJ like you a faggot isn't met with 1000 "omg u don't support da troops u terurist!!!" red blooded soccermoms
a logical progression from "ur boots aren't bloused properly" to "STOLEN VALOR REEEEEEEEEEEE" requires quite a few steps.
But fuck "homeless" guys pretending to be veterans. If you want to exert mob justice roll past your local highway intersection with a guy in a woodland jacket holding a sign saying "plz help" and kick the shit out of him.
Eh of some jackass is pretending to be a CIA Marine SEAL to get pussy or a 10% discount at Subway who the fuck cares. Most of these guys are sad as fuck and usually get humilated sooner or later. My issue is when they get money from charities or the VA for s
>>"STAFF SERGEANT? YOU DON'T LOOK A DAY OVER 8
>also extends to lying about your military service on the stand during witness testimony in a criminal case
What you linked doesn't prove that let alone even suggest that. Learn to read.
All you fuckers laugh at this shit but something like this happened to me.
>be around 12
>walking in a flea market with my dad and uncle
>wearing a shirt that says devil dogs on it and says something about the marines, i really cant remember, just thought it was a cool shirt
>walk past a bunch of biker lookin fucks
>one of them walks up, sayin "where you a marine?"
>four or five of these fucks in their late 40's early 50's gather around me
>this fucker was serious, really thought i was trying to act like a marine
>my dad has to intervene and say "no but his uncle was"
>they fuckers don't really say much but walk off.
I thought it'd should be treated like impersonating an officer, but personally I don't give a shit either way.
I saw brave men get nothing, and shit eaters get Bronze Stars.
Fuck your medals, if you were worth shit, your guys already know it. No one else gives a shit anyways.
If you're wearing you're uniform to go shopping at walmart, with all your medals hanging off of it, legit or not, you're a tool.
ITT: Brave SHALL NOT BE INFRINGED liberty loving citizens shit all over the defining amendment of the United States Constitution.
Guess what. You don't get to pick and choose. That's what makes it free speech.
