Why is cheating legal?
It's still illegal in some places, but law enforcement won't press charges for it because the police are corrupt. Apparently they are only there to interpret the law, not enforce it.

it's always dumb when people hate on islam for the things it does right rather than the things it is genuinely wrong about
Several reasons. For one thing, we're still figuring out the whole legal "emotional distress" thing even when it results from physical injury. Suing someone in a civil court for emotional distress as a result of cheating would be incredibly convoluted and difficult to prove damages for. We allow infidelity as a cause for divorce petition but that's because there are money and assets involved. Also, marriage is a legal and contractual relationship. Dating isn't. Good luck measuring the seriousness of your relationship in a court of law.
