Because legal marriage provides legal benefits, AND trying to take away legal marriage would receive a lot of opposition from straights, while those who aren't blatant theocrats can just be indifferent about gay marriage. Ideally we would have a separate term for legal marriage to get rid of the confusion with religious stuff, but even that would probably be seen as too much of an imposition on straight people to succeed.
