Depending on where you live, they don't have to write it in their ToS because its simply illegal by law (for example the shit country I am from, Germany).
Also I don't think you'll get something good. Most stuff thats interesting is HTTPS secured, so no login credentials = who cares.

Highly illegal, at least in the States. Unless you have express permission to capture their traffic you can get fined or even go to jail. Getting caught is another thing though.
