That's actually a good argument. Ads are entitled to a certain amount of "trade puffery" when it comes to those things, you can't expect an ad to be 100% accurate about their product because it's an ad. Same way you can't hold a used car salesman to their claims about something being "the best car ever, everyone I know has one". Not to mention, depending on the extent that the particular advertisement was distributed it could be said that not enough people could have reasonably relied on that ad to guide their decision to purchase the phone to justify a class action. Even then, you'd have to prove damages and there really aren't any. Nobody bought a phone expecting it to be exactly twice as fast otherwise they couldn't do a thing.

Those are declarations made by the company, not some loser salesman. For him it might as well be the best car, he's the judge. You can argue that there are different measurements of phone's speed, but "half the price" is a clear-cut statement with no room for interpretation. Also, previous times when rules were broken don't justify the abandonment of those rules, otherwise america would make homicide legal.
