This particular instance won't be disputed over a technicality: EasyList isn't meant to have anti-adware domains. EL is an ad domain list only.

Should Admiral try the same trick again on other lists, yeah, that'll get disputed. Maybe they'll even find counsel stupid enough to actually pursue this along copyright lines.

My site as an Anti-Adblock (hosted on x site) plugin, that, unless you have your adblocker disabled, it won't load the content of the site.
If you block the anti-adblock script, you're "circunventing" the drm Im using to "protect" my content, thus you're effectively pirating my copyright protected content.
X site doesn't hosts any ads, but merely just the script that checks that you're not using an adblock, so, it cannot be added to anti-ads blocking lists.

I honestly don't care. I don't even use an adblocker on one of my machines because it makes pages take slightly longer to load due to how weak that machine is. Just use an addon like uMatrix and only allow scripts/pictures/frames/whatever that you actually need at the time. The only reason I even have uBlock on my main machine is to filter out elements that sites like 4chan add on certain days of the year if I feel they're annoying.

To clarify: this isn't a copyright claim. DMCA doesn't deal only with direct copyright violations, it also deals with code that is used to circumvent copyright access controls.

Except that this isn't an access control in the manner of encryption keys. The entire content of the site is first delivered in a totally accessible form to the visitor. Then a second element is loaded atop the already transmitted content. The copy right in question here is one of distribution. Once the material is distributed, the manner in which it's enjoyed by the end user is outside the realm of copyright. It would only become relevant again if redistribution happened.

So DMCA would apply if:
1) the website data was only transmitted if, by obligation of the copyright owner, the visitor agreed to disable ad-blocking, or
2) a person was re-hosting the website's data without both the permission of the copyright holder or the inclusion of Admiral's code.

Neither of those is happening here. You can't give me a publication of yours and then tell me how I'm allowed to read it after I get it. You can only set your terms in advance. This is a misapplication of DMCA.
