To add on to this, a majority of the kernel codebase is pretty good. It certainly gets ugly (NTFS, Compatibility layer, MSE, and the loads of undocumented shit they leave in) in places but it's still solid code. The really shit parts are userspace and where userspace and kernel interact. It's not uncommon though. Darwin has the same problem withe the mach and BSD portions of it's kernel. They are nice on their own but things get really ugly where they meet.

This would actually fuck stuff up bigtime. Any developer that would ever even so much as glance at the Windows source code would be ineligible to work on any even mildly related open-source project, lest they open the project up to legal action.

When reverse engineering (as the ReactOS people and the WINE people are doing for instance), the engineers must be "virgins," meaning they must never have 1. contacted the manufacturer 2. be related to anyone who works or has worked for said manufacturer 3. never seen the source code of the product being reverse engineered 4. never seen the design specs for the project being reverse engineered.

ReactOS actually had to get rid of a couple of their devs because they read a portion of some leaked codebase that was relevant to the project.
