It was a variant. I know that some shops, for some reasons, apparently run out of actual standard covers and normal costumers end up buying variants they didn't ask for, but for 99% of cases, nobody that didn't want that cover needed to buy it.

Cho's situation is different for 2 reasons. One: He is not the source of the controversy he is responding to it, and responding to it with the best defense around, comedy/satire. The Dini cover, shows both Bat and Joker, effectively as spectres - devil and angel and there's no direct indication that it was Joker who did (especially in context of the plot).
