It doesn't matter. Networks don't like to take risks so they make their employees sign contracts that prevent them from taking ideas from the fans. In rare cases, an instance can be approved by the network, but even then you would need to be dealing with somebody specific. In this instance, the "creator" of Penny's deer design posted anonymously. That's not legally kosher.

We all know it's stupid, but then again the following things are also stupid and happened:

Suing God
Suing mcdonalds for being fat
Suing a judge on a rape trail because he used the word "rapist"

Nowadays, this isnt even about winning or losing, but rather about bad publicity, small as it may be, hence why a lot of these kind of frivolous cases are solved out of court.

But regardless of how stupid, or unlikely, the fact is, CN still has policies to prevent it, so you know, it has to be an issue to some degree, no matter how unlikely and laughable it is.

That's because networks would rather not waste time and money crushing idiots who more than likely don't have the money to repay them in a countersuit. So they'd rather their employees not screw around. At the same time though, they don't expect their employees to somehow know what ideas fans have made and thus to avoid them. Hence why they are just given free reign instead of giving them the contradictory order of "don't read fanfics, but don't make stories that resemble fanfics.
