"Rights" ties in with certain narratives but standards of care should certainly change depending on the intelligence of the animal. Smaller issues with their environment cause bigger problems with stress levels and such with increased awareness.
With regards to the captivity perspective the main thing is that cetacean captive spaces should be fucking huge, with focused work to properly care for them. If an establishment can't handle that than they should be penalised for breaching ethical standards
