So I had a female friend who was married (that I knew semi well since kindergarden, in late 20s now) ask me for money for plastic surgery. I said i am ok with it, if her husband is fine with it and they sign a contract.

They signed a contract. Friend cashed my check got work done. They repaid about a fifth, then got a divorce. They completely stopped paying me. I was patient with my friend for about a year and a half letting her delay paying me back. She suddenly cut all contact when I started asking about it a few months ago.

I decided to ask a lawyer and he said my contract will hold up if I go to court and that they are both liable because it is outstanding marriage debt. I have been considering just dropping it because the husband didnt spend the money and the ex friend is very poor as far as I know. But she responded to my fist text in a long while when I mentioned I had a lawyer she told me to "fuck off".

For logistics I gave them 5K got 1200$ back. Lawsuit would cost up to 2700$. Which I could ask they pay the fees. But they may be too poor to pay even if I win. I could maybe go forward with the lawsuit to prove a point, but would rather not.

Both ex friend and husband are horrible people. Turns out they both have had multiple run in with the police with drugs, property destruction, domestic violence and assaulting officers between the two of them, and they have 3 kids.

I knew it was extremely stupid to lend them money. As to my thinking my mom died a few years ago either murder or suicide, its an open case still. I was extremely sympathetic to women with problems and this was my big mistake but also years of really shitty dating.

Again though, suing them may just mean OP is out more money. If the deadbeats aint got no money or assets, all a judge can do is send them to jail I guess. OP will only get emotional revenge, but his money's gone.

But OP, depending on where you are financially, if you can risk blowing 2700$, then its worth a shot. If you havent already, tell your lawyer you have no idea if they even have any money at all, and ask his opinion. If it's better to cut your losses or risk going into the red anymore.
If they have jobs that you know about, ask if it's possible for the judge to garnish their wages if youre concerned they wont pay up nicely.

I should clarify a little. I am not a 100% out to get all my money back. I was very willing to work with them even though they violated the contract. But when they cut and ran, and were dicks about it after I was flexable I looked to a lawyer.

Im would be willing settle for a partial payback and a big part of my hold up is that if i go forward I could loose more money, but I am almost willing to take the risk to prove a point.

I know the husband is employed, the exfriend never blocked me on facebook and best I can tell has mostly been a waitress or living off of boyfriends since their divorce.

I think you should go for it, especially if you have them pay all legal fees. If you don't take them to court, they will never ever pay you back and since you say they're horrible people, they will not give a fuck about whatever point you're trying to make.

I could also have the lawyer draft a letter of threat of lawsuit to try to force them into mediation. Once again I dont expect getting all my money back despite the contract. I was letting them delay payment for a year and a half while they got through the divorce stuff, because they had kids. I just dont want her getting away with acting like a twat.
