Birds fly into windows and break their neck on a pretty regular basis. The fact a flight-capable bird has a broken neck isn't terribly compelling proof that someone killed it, they're not going to call Bird CSI in to find the DNAs and catch the murderer.

OP, I don't know your brother and how likely it is that he actually killed your macaw, but he's not going to go to jail for what could have been an accident. It's not uncommon. Birds fly into windows and mirrors quite frequently- usually they're just stunned, but they can definitely break their neck from it.
