Not in manga, just anime. It's fine to portray underage smoking or drinking in manga. For example, Nobue from Ichigo Mashimaro smokes and drinks in the manga at age 16, which is why she is said to be 20 in the anime. In Hidamari Sketch, during the first party to welcome Yuno and Miya to the apartments, Hiro intentionally gets all the girls drunk (yes, even proper shy Yuno has no problem with underage drinking). There are plenty more examples.
From what I've read underage drinking is basically par for the course for almost any teen in Japan, and it starts being a social responsibility before it actually starts being legal. It's just that's it's a no-no to directly address it in anime (and even then, only in TV anime - it's fine in OVAs and such, such as episode 7.5 of Sora no Woto).

In truth, it's probably tiered.
Age 14 would be limited responsibility, where you won't go to prison indefinitely even if you tortured and murdered 20 children in an honest attempt to summon the devil and bring about the end of the world.
At age 18, you can probably expect harsher punishments, including the death penalty.
Where I live, voting is tiered as well, with communal votes being open to 16 year olds, but the real elections requiring an age of 18.
Drinking is the same way. Beer for 16 year olds, hard liquors for 18 year olds. Other maturities are also tiered.
People often forget that, and just respond by whatever comes to mind first.

I'm not aware of the actual legislation, but what's odd to me is that someone at the age of 14 could be criminally prosecuted, and yet have no voice in what matters for the country.
The way they avoid underage drinking in anime is just beyond stupid. Especially with the stuff like becoming drunk on fumes or after eating a candy.
