Pretty sure it's implied that Chariot abandoned or knowingly failed at her role in reviving magic, so she probably 'lost' the staff in the woods herself, or was forced to return it because she failed.

It's clear at least that the woods are going to be important in the whole triskellion plot, so it likely wasn't an accident that the staff was found there.

And again, at least she was able to fight back against them at all despite the fact that at this point, her only magic skill is transformation, and even then, she's not perfect at it and it's still hard for her.

I actually like the underpowered Akko dynamic. Despite being horrible at magic she gets shit done in her own way and ends up being more impressive than the naturally talented somehow. Talent hits a target no one else can hit, but genius hits a target no one else can see. I think this is exemplified as Akko's character especially in episode 13, but even as far back as episode 2 when she saves the butterflies. While Diana's first reaction (as would be most peoples) was to deal with them violently, Akko's intuition allowed her to see what was really going on.

Also from a writing standpoint, if she was like she is now but ALSO talented as fuck in witchcraft she would be a mary sue. She is very balanced right now. If she ever gits gud she will easily become a top witch if not the best.

The rod wouldn't have solved any of her problems if she didn't put in effort to solve them herself in the first place. It only lends its powers at the height of the moment when she needs it the most, and for a temporary time. I guess you can call it a deus ex machina in that if she didn't have the rod, she wouldn't have been able to pull off most of the stuff she has, but only in the same way a soldier could not succeed without a weapon.
