The Tokyo District Public Prosecutor's Office and the Tokyo Regional Taxation Bureau charged 41-year old Log Horizon and MAOYU light novel author Mamare Touno (real name Daisuke Umezu) and his intellectual property holding company m2ladeJAM (pronounced "marmalade jam") with tax evasion and violation of the Corporate Tax Law on Monday.

Touno allegedly failed to file 120 million yen (around US$996,438) in royalties from the printed versions of his MAOYU and Log Horizon novels for his income tax report in a three-year period ending last year. According to the prosecutor's office, Touno owes the Japanese government 30 million yen (around US$249,114) in taxes.

When NHK reached out to Touno for comment, he said, "I've paid my taxes, but I can't comment."

Touno launched his Log Horizon light novel series in March 2011, and his MAOYU light novel series in May 2011. Log Horizon inspired two TV anime series. The first season premiered in October 2013, and the second season premiered last October. Yen Press announced last August that it will publish the light novels in North America.

MAOYU also inspired a 12-episode television anime series that premiered in January 2013.

Probably not technically, but who knows how stressed he'll be by the whole thing. Ordinarily they wouldn't even just up and charge you, I mean there's usually months of them sending letters and collections and stuff (again, in murrka) before they start threatening legal action. So I'm wondering if he's just been exhausted by all the publicity and success and ignoring his mail for a year.
>>
>>123969295
Yes. I believe the courts generally interpret the law so that only vaginal sex counts as prostitution. Which is why some brothels specifically have rules against asking for the "real" thing.

It seems a he himself had a scare when a taxman visited him a few years ago, and it made him extra careful about taxes from then on. It seems there is difficulty for a creator to make the leap from creating a franchise as a hobby to running a buisness.

Actually that varies depending on who you are and what you own. In some cases, the gov't has seized and auctioned off property immediately and used that money to pay the fines. It is THEIR determination as to which will pay off the penalty the soonest. What you can do is get an injunction from the court authorized to hear such requests. If they are backlogged, then you fail. Unlike local criminal cases where the backlog doesn't matter if you start the process, with the IRS injunction, it is your responsibility to actually GET the injunction and not just start the process to stop your property from being sold to eager capitalists. There's a whole industry based upon buying distressed capital and distressed property. The problem is how much collusion all that money can create with IRS and judicial branch employees. You can imagine what happens if a clerk delays filing your papers due to loss or misplace or unknown oops.

As a general rule, you only go to prison for tax evasion if the government wants you in prison and can't convict you of an actual crime. For example, Al Capone. Otherwise, you just pay them a lot of money. Putting someone in prison costs the government money, while the point of enforcing tax is to get the government money. But pretty much any time the government sends someone to prison on tax charges, it's political. Even Conrad Black and Martha Stewart type shit.

I imagine an author's income comes from multiple sources based on how much there works have sold and licensing deals with anime studios and foreign distributors rather than a set contract with a firm for X amount so it's probably pretty easy to forget to declare one form of income.

No rape but the isolation will break you due to all the space allowed for isolation cells which ironically are used as punishment in US but are regular treatment for all prisoners in Japan.

>How do you even forget to pay taxes? Do the Japanese have super complex forms that include cows and rupees and number of blades of grass on your lawn?
ZUN said that it is what happens when someone who used to just break even playing a hobby, all of a sudden became successful due to a breakthrough hit. If you never had to pay taxes before because your old desk job pre-deduct your taxes and your hobby was not profitable, then once you quit your job and started doing your hobby full time, it is easy to forget that you would need to pay taxes now that you are your own boss.

>>123971877

For many people in this situation, it is the first time they became their own boss. If you never worked for yourself before, you might not know you need an accountant.

Don't know about Niptax law, but in the States, if you substantially underreport just about the highest penalty they can slap you with is 40% of the amount by which you underreported. This rarely happens, as you pretty much have to either have failed to hide an illegal tax shelter or else have to engaged in a bona fide sham transaction before the the government will hit you with that.

So, if Jap law is like US law, the worst he would have to pay is 350k (the 250k he owes plus 100k penalty). People were saying that the top marginal rate for corporate tax in Nipland is 30%, so that would mean his company's income for the three year period would come to somewhere north of 833k.

So assuming he's got at least 350k of fairly liquid assets to pay the taxman out of his approximate 833k net worth, he shouldn't have any trouble.
>>
>>123972838
One million dollars from LN sales is fucking ridiculous, clearly that official must be miscalculating something. He probably thinks the royalties rate is higher than it really is.

Tax evasion is fun, if you take the right precautions. People don't realize that only around 1% of all income tax returns get audited. That number drops even lower if you know what patterns the IRS's computers look for in determining candidates for auditing.

As long as you keep your head down and are prepared to make a semi-plausible argument that your tax stance comes from a grey-ish area, you're practically free to play around with no consequences even if you get caught other than being ordered to pay the money that you were supposed to pay in the first place.

Remember, there's a statute of limitations for most of the underreporting you will end up doing.

>The IRS got Al Capone when even the FBI couldn't get him.
That's an unfair example to use now due to current technology (video, etc). The FBI failed waaaaay back then due to the lack of practical communications and long time delays as well as the lack of protective devices and surveillance gear/techniques. They have such technology now.

The FBI also failed because Al Capone or his allies got to all the human witnesses. First of all, the witnesses knew that after the trial was over, police protection would end and their family and friends' identity and locations would be known due to leaks in the government. Al Capone was known to go after witness family members and friends. Most possible witnesses thus refused to testify or pretenced memory loss or even destroyed their own records to prevent the gov't seizing them and forcing those people to be witnesses. Importantly, Government corruption existed and was widespread. Thus, your privacy data was bound to leak and you would be killed. So, there was hugely negative incentive to be a witness. This was also backed up by witnesses under police protection being killed successfully before or after other trials.

Back then, this left the IRS as the only agency left with witnesses (tax records) that could survive assassination attempts from organized crime.

Meerupo is a story about Ai-chan,a tsundere loli with the hots for her nii-chan Mamare. After Mamare gets a job to support them both, he starts getting letters from IT-chan, Internal Taxes Channel, and Ai-chan thinks its from a lover and throws them away.
They decide to run away from their towering debt and have to resort to doing oddjobs on the countryside for food and lodging, where they meet quirky characters along the way.
During many of their nights under the stars, sharing a sleeping bag, their relationship evolves into a beautifull love story between brother and sister (not blood related).

BRB, making a million.

If he cannot pay the fines, the government would take possession of his IP rights as they have value. IP rights can be sold of course. You forgot that the usa law also requires that illegally obtained income OR barter goods are taxable as income too. That is how they charge drug dealers with more crimes because the drug shipment value is taxed. That is how they get around needing a court case to prove all the money the dealer has is legit. The taxable value of the drug shipment generates so much tax that it means none of the money will never be returned to the dealer.

Oh, I didn't forget, my taxbro. §61 is just the tip of the iceberg of fuck that is US tax law. >Cash receipts from dope dealing are part of adjusted gross income, but the wages you pay your dope dealers and your inventory fees are deductible business expenses.

You can't file those deductions!!! That would be admissible guilt under RICO Act. Once RICO applies to you, the government can seize ALL your possessions, so at that point, any deductions don't matter because all you have is gone. You used your car as transportation during drug dealings? It is taken. You lived at your home while taking even one phone call there for drug dealing? That home and property is lost under RICO. So that is why you cannot apply for deductions for those illegally obtained earnings. They will be 100% taxed without deductions. You have to bite the bullet there. Admit no extra guilt.

Ha! Joke's on you. I don't plan on living that long to begin with.

>>123981037
Some states actually let you purchase "drug stamps" (pic related) that you can use to avoid any potential tax liability while not incurring any penal liability. I actually bought one once, as a joke. I had to do it at my state's capital building, in person, and I ended up being led to a private room with a telephone. After five or so minutes, someone called the phone, and they asked me some questions (but nothing that would lead to potential incrimination on my part). After about 30 minutes I was able to purchase the drug stamps in cash money. It was strange.

But anyways, some people have experimented with filing what they call "Fifth Amendment Tax Returns" to try and fix that problem. It's unknown how this will pan out in the future.

Jesus christ, so you can go into tax debt from someone relieving you of debt?
>>
>>123981619
It's not favoritism if the bank get some dosh in return.
>>
>>123981824
No, if you think about it, it's actually a gain. Imagine this:

You are a company, and you sell 50 bonds worth 100 dollars at a 5% interest rate. Subsequently, the interest rate jumps to 8%. The person whom you sold the bond to will then want to get rid of the bonds, because this will let them free up their 5,000 to invest at the new rate. But nobody will buy them because they are fixed at the lower rate. So, you offer to buy them back at a discount, say 75 dollars/bond. You have effectively gained 1250 dollars in cash for doing nothing except buying back your debt at less than its face value. It only makes sense to tax you for that gain.
>>
>>123982044
Ah, I was thinking in terms of personal debt, not shit like bonds, thanks /a/non. Fuck this shit I'll make my mom do taxes.
>>
>>123982169
Don't worry, friend, and tell your mom not to worry, either! If your personal debt is forgiven because you're actually broke, Uncle Sam won't count this as income and tax you for it! Actually, he will, even though he says he won't. He will just defer collecting on it until you're back on your feet, and then he'll deny any tax offsets that you could possibly claim until you've paid back every last penny that you owe him. It could take years, or it could be until the rest of your (or your mother's) life.

>The popular construction here in Europe is making a one-man 'company' and letting it pay for every expense you have.
>I don't know the fine details, but that's rughly how it works.
It's popular in the USA too but there are several types. The typical small business must have a minimum income to qualify, so sets of friends will buy and sell services from each other's companies in a closed loop environment. The muslim immigrants are doing this a lot in one of our local suburb cities. It's one of the larger muslim immigrant enclaves in the usa. They're almost able to vote in their political representative now, but the republican and democrat parties have joined in together to fight that (a very rare case of those two working together).

Besides a small business owning your car, renting a home office space in your home to reduce your total taxes, and paying for meals, gas, dry goods, coffee break foods, business meals, and certain business appliances and furnishings, it can also pay for medical care, drugs, and vacations.

The rich form non-profit organization/corporations as tax shelters which still work. Tax laws say it must have over a certain minimum income. Thus only the wealthy can use that loophole. A former friend and penpal (now dead of old age) was the recipient of one so that's how I know. The non-profit owns the homes, cars, properties, investments and takes orders from YOU (as well as employs you contractually) and before you die you instruct it to take orders from your heir, thus transferring control properly without inheritance taxes. Oh, it's time for you to check if people in hawaii need donations, so you are sent to hawaii for 2 weeks. Just document your trip with a report saying you actually searched as well as donated a dollar (or whatever legally qualifies) to someone. In my republican party state, the legal minimum is 1% of earnings for a non-profit corporation. Such laws exist due to voter MEH attitude.

Isn't that how SJW Patreons tend to work?

That's pretty interesting.

But unfortunately it's all bullshit.

True enough, people can (and do) use passthrough entities to gain certain tax benefits, and it's pretty common to write off personal expenses as business expenditures. But if you could plausibly fabricate a public benefit corporation that really only existed to benefit yourself and nobody else, then everyone would do this.

And that bit about the estate tax is patently untrue. The estate tax has been effectively abolished in any real sense for years now as it applies to the vast majority of taxpayers. And those to whom it might actually have meaning just use revocable or irrevocable lifetime trusts to handle their dispositions.

Back in the 1990's I attended an evening meeting at a small home business studio of such people trying to set up small home businesses. I was just starting out my engineering career so I was not so worried about taxes then, but went out of interest.

I bet ebay makes forming such businesses much easier because it is a convenient way to acquire customers and cash flow in order to justify the existence of your small business for tax purposes.

>Some states actually let you purchase "drug stamps" (pic related) that you can use to avoid any potential tax liability
I wonder if those things were created by the legislators in order to protect their own families or rich people from prosecution. Those people would be notified of any impending investigation, so they'd then rush over to buy the deduction stamps and voila, they escape that part of the investigation.

You forgot to consider the age of this corporation. It was established long ago before the rich people and their lobbyists effectively abolished inheritance taxes. The founder of that corporation was from the 1800's. My friend was the third generation in that corporation. So the cost savings went on a long time.

Wow this guy is seriously an idiot. Tax evasion is the easiest thing to get away with. I've gotten away with it for years by not having a job or money. They can't catch you if you if they can't tax you.

That's an interesting thought. From my research, it seems that the genesis of the idea was a SCOTUS decision in 1866 aimed at preventing Fifth Amendment double jeopardy violations by charging someone twice for the same drug crime. That's why so many states in the ensuing years passed into law their own drug taxes in order to comply with the Constitution. I wasn't able to find too much about the motivations for the relevant statute in my state's legislative history, but maybe you'll have more luck. At any rate, the "drug tax" still gets my vote as one of the most hilarious and bizarre modern implications of tax law.

Lots of people make a living from NPOs that they make decisions for. You're the one that doesn't understand. Also, you only consider NPO to be public benefit corporations (charity) and that is not true in our 4chan populist sense. In the strict technical sense, you are correct provided that you have applied that state's definition of an NPO. In my state, a Charity NPO is different from a normal NPO. A charity NPO is required to provide public benefit of at least 1% of its earnings. Some of the scandalous ones give away only 2% of their earnings and the rest go to their employees.

The United Way is a well-known charity fund. In my area, it was written up in the liberal newspaper (now defunct) for paying its regional president and staff a huge salary and lots of other benefits including buying clothing and other consumers. It even had a 30 million office building built and furnished. The load factor for some charities is pretty large because their managers get to influence their salaries and benefits without the same pressures a for-profit corporation has towards supporting shareholders, institutions, and instruments tied to it.

Its no secret that the CEO of these supposedly NPO's are making millions dude.
Just look at Red Cross, the CEO there makes what, around two million dollars a year, sounds pretty profitable if you ask me, while The Salvation Army aint paying salaries to any of their employees.

However, corporations are allowed to exist unlike those short-lived living trust perpetuities. I remember Ursula LeGuin (author of Tales From Earthsea) using a Living Trust to hold property and IP until the law changes made perpetuating tax avoidance unusable with that method. I was volunteering at a fan convention at that time and someone had collected some interesting info on LeGuin who was one of our GoH (yes, of course we paid her expenses).
