They aren't, this guy is just spewing bullshit about how they "archive" sites so they aren't responsible for what others put up. A C&D, and those roms are gone. The archive is just mostly immune from legal action for hosting them, but they can be pulled.

Besides, good luck getting CD based games off the archive.
