Orcas are dolphins, yes, but they are much bigger, have a very distinctive coloration, they are scarier, associated with violence, etc... so since they represent different things that deviate away from the dolphin norm they are considered separate in the popular mind.

Even with kyogre, another orca pokemon would be justified, kyogre is so much more than just "the orca pokemon", has the weird fins, is a legendary, has parallels to leviathan, lacks the iconic black and white look, etc.

So yeah, as I said, pokémon still lacks a proper dolphin AND orca pokemon, there's no need to be so uptight with biology.
