the twitter guy has some information backing this up. Earlier today i went about trying to figure out what game the hack was in by the information he was willing to give out. and here is how i also came to the conclusion it was DOA.
My first bit of information came from his original post on the game availability:

"the homebrew loader we're about to release will require
you to have a specific retail game. the game is also on
eShop but not in all regions"

so using this website: http://en.wikipedia.org/wiki/List_of_Nintendo_3DS_software I found that there are only 18 games with limited eshop availability.
I later found out that the game was available in europe, and seeing as how the twitter dude is in america, this rules out 2 of the 18 down to 16.

the next one is a big one, the twitter dude was asked if the game was available in japan, and he answered "yes" within a few seconds. this rules out 9 giving us 7 games left.

and my final piece of information that led me to believe it was DOA, when questioned on the game's availability in austalia, the twitter dude said "isn't australia basically europe ?" I then learn that only 2 games out of the remaining 7 had no mention of australia on their wikipedia page. i mulled them over for a while before i realized "Pro Evolution Soccer 12/13" had no mention of eshop availability on the wiki page and DOA did. and i knew the twitter guy wasnt using the same list as me or he would have known it was available in australia.

Feel free to check my work. My only gripe is i don't know if that list of 3ds software is totally correct or not.

Well shit. Would it be worth it to get into the homebrew scene this early in the game? I have no reservations about buying DOA (fucking $20 on Amazon), but I don't necessarily want to softmod my 3DS and deprive it of updates/risk bricking it since this shit is so new. Softmodding my Wii was probably the best thing I ever did to it, but that was already well into it's lifetime and the homebrew software was solid. What would be the benefit of softmodding it at this point? And would I be able to go back? Kinda asking out loud since I guess no one can really know at this point.

I think I'll probably just end up buying a copy of DOA used and sit on it while this shit goes down.
