Its actually not. One of the key witnesses will likely be one of Brown's friends who was an accomplice to the convenience store robbery they were fleeing from. This friend is one of the first to claim that Brown was attempting to surrender. This is the only case the defense can make, and it will be utterly destroyed by the ballistics report which will reaffirm what we already know. He was in fact running towards the officer as he was firing. Brown's wounds could not have been produced otherwise.
