I'd imagine it's because technically they aren't being tried again. They're still guilty, but their sentences are being adjusted since the judge who gave the original sentences acted beyond his authority.

There's some weird junk in there about mandatory minimum sentences, but the prisons are clogged with way better examples than these guys. It got out of hand and spread to fed land, and it only damaged $100 and actually the BLM estimated that it increased the lands value as those burns happen to do. They put it out themselves

The 2nd burn was to protect their home from a fire that started very late. They burned a patch so that the fire couldn't spread. You know, fighting fire with fire. The thing is there was a burn ban in effect and there was no feds awake to give them permission. They did it anyway to save their home.

Let's ignore the feds starting fires for the same reasons, but they spreading and causing much more damage and yet nobody is charged for those.
