Is anyone else surprised at them making this much on Patreon for a video of this quality? No really, some parts were funny but not as good as past episodes by a margin. And who can really say how much their content is valued at. Do they still even do this Patreon? Or is it just there? You'd think they would get C&Ded or something but hell if I know.

Again I don't really care but I am genuinely curious as to what their Patrons thought of this. After all they are the ones probably motivating Sherclop to do anything at all.

The issue has never been brought to court. And it never will, because average Jenny's don't have the money to challenge a DMCA takedown notice. So in practice, Fair Use literally doesn't exist. I'm all for creators being able to get paid, be they Hasbro or fan artists. IANAL (phrasing!) but if it came down to it, I'd think FiW, MAS, RDP, etc, are all sufficiently transformative that they'd stand up in court. Hasbro doesn't want to risk the money they'd lose if they took it all the way and actually lost on the merits. No fan artist can afford to take it all the way if push comes to shove. So here we sit at a stalemate.

The real question is whether fan art like FiW is made for money or for the lulz. I'm all whynotboth.jpg here except that this lawyerpone was cuter.

But when it comes to deciding how to categorize one's transformative content, the decision to try and monetize versus "fuck it, let the record company and Hasbro fight over the scraps" is always a tough one. Whether you're recruiting your own VAs and doing your own animation where needed, or whether you're just a lowly PMV creator splicing clips together against your favorite song.

However, whilst going to court is quite a hefty sum; consulting a lawyer is not totally out of the question. I wonder if that is one reason this took so long to come out? Well that part you quoted actually makes sense to me. Dash and Fluttershy just arrived to Cloudsdale to sign up for the competition, they landed right next to the weather factory. Fluttershy reminds Dash why they are there, but Dash doesn't really want to sign up, so she needs to kill time to "accidentally" miss the deadline.
The first hint you can see is when Fluttershy mentions the competition, Dash's ears... what's the word, flop? Fold? And she frowns a little as well. Then she looks around, and because she needs to distract Fluttershy asap the first thing she sees is the factory, so she proposes the tour (btw. she says oughta, not gotta), trying to bullshit her with some phrase about it that sounds like from a tourism guide or maybe even school.
But Dash probably doesn't care about the factory that much and because Fluttershy didn't take the bait, Dash tries to come up with another idea, something that caters more to Fluttershy. That's why they end up going to the zoo after all. The yellow one likes animals.
