The constitution applies only to those we have ALLOWED in and in fact should not be extended to illegal immigrants or non-US citizens that have not entered with our* express permission.
If we can't deport illegal immigrants, then there are a couple BILLION people that would want to be here and they would come as soon as they knew there was no chance of being deported.
If American rights and civil liberties apply to everyone, even non-citizens not on US soil, then we need to enforce them for people in the heart of Africa, SE Asia, Indonesia, Central America, etc. Because by our standard, almost all of the world governments outside of Western Europe would be violating their constitutional rights.

There is a reason amnesties have been granted more than once. It's easier than fortifying hundreds of miles of border and rounding up and deporting millions of armed civilians.

Their hands would be forced because they could not allow the chaos that would ensue from attempting to remove 14-20 million people.
And it's not rightly fair considering they have intentionally neglected the situation to their own financial and political gains, skirting the issue of reform.
Also, they need to amend the law to make it clear that only someone who a parent who is a US citizen is born a US citizen. Every country on Earth accepts the children of their own citizens born abroad as their citizens with the ability to return.
No presidential candidate can honestly offer you new law.
Because the executive branch has no right or business to be writing new law.
Not that our political sphere and media don't portray it in that manner these days, making the president the scapegoat for any and all issues, a lightning rod for public discontent.
But the president can enforce the law.
The president can use the bully pulpit to criticize, harangue and pressure the rest legislature and the courts.
But they're doing just the opposite, trying to confuse those who don't know any better.
