But everything he said was 100% correct. Brainiac has killed trillions and is probably the most dangerous being in the universe (they just barely stopped him here due to the betrayal of Lex Luthor). You'd have to be out of your mind to not kill him because it's "wrong", especially since he broke out of prison in the arc right before this, and does so again in the arc after. There's no clearer case or legal execution imaginable, they're literally standing in the smoldering ruins of one of the cities he destroyed while having this conversation.
