Anyone can sue for anything in the United States. It's the court's job to determine if your suit has merit.

There's a grocery store by my house that used to sell their Chinese take out in the traditional 3D rhombus cup with a metal "handle". They, probably for both cost reasons and convenience reasons to appease the lazy slobs who actually order it/take it home/eat/reheat it, switched to ones without a metal "handle". Now they advertise on the cups that they are microwave safe! cups.
I bet somewhere on that charred wrapper of yours there was at least a picture of a microwave with a line through it.
