no, they aren't, you're right. but, it's a systematic problem. most people whose job entails tipping make less than minimum wage and are only given a paycheck when their overall tips don't add up to at least the minimum wage equivalent of that number of hours worked. So, sure, you don't have to tip, but most delivery drivers don't get anything out of the delivery fee, aren't reimbursed for gas, and their basic wage is dependent on it. I'm not saying it makes sense, but if you're going to participate in a system like this, then play your part instead of acting like you're entitled to service like this at no additional cost to yourself.

They are legally allowed to pay them less then minimum if the tips the workers receive would bring their daily total pay to at least what it would've been with minimum, but if they don't receive enough tips to make up the difference the employer has to cover it.
