Recording the audio of a private conversation is only legal if both parties are consenting.
If one part is unknowingly being recorded, then the person doing the recording is committing a crime.

This is true in a handful of states. Pennsylvania happens to be one of them. In the vast majority of states you only need one party of the conversation to consent to recording.
It's only thrown out based on the exclusionary rule if the person who made the recording (illegally) was with law enforcement or working under the direction of law enforcement. If some unaffiliated guy does it, it can stay in (though he would still be charged for making the illegal recording).
